Terms and Conditions
Last revised on: 16 October 2026
1. Who we are
This website, justphoenix.io (the “Site”), is operated by [COMPANY LEGAL NAME], registered in the Republic of Serbia, company number (MB): [MB], tax number (PIB): [PIB], registered address: [ADDRESS] (“JustPhoenix”, “we”, “us”). Contact: [EMAIL].
By using the Site, purchasing our products or ordering our services, you agree to these Terms. If you do not agree, do not use the Site.
2. What these Terms cover
- Use of the Site;
- Purchases of our digital products (software, plugins and licenses) through the Site;
- Our services (custom development, websites, migrations, digital signage, security testing, server management, backups and Care Plans), to the extent no separate written agreement applies. Where a signed proposal, quote or contract exists for a project, that document prevails over these Terms in case of conflict.
3. Digital products and licensing
Products sold on the Site are digital goods: downloadable software, WordPress plugins and subscription-based platforms (such as Signetix).
When you purchase a product you receive a non-exclusive, non-transferable license to use it in accordance with the license terms stated on the product page (number of sites, machines or screens, and the included update and support period). You do not acquire ownership of the software.
License keys are issued automatically after successful payment and delivered to the email address provided at checkout. Keep your keys confidential; you are responsible for use made under your keys.
You may not resell, sublicense, share, reverse engineer or remove license enforcement from our products, except where applicable law expressly permits it.
Updates and support are included for the period stated on the product page. After it expires, the software keeps working, but updates and support require a renewal.
4. Payments — Paddle as merchant of record
Our order process is conducted by our online reseller Paddle.com Market Ltd (“Paddle”). Paddle is the Merchant of Record for all orders placed on the Site: your purchase contract for the products is concluded with Paddle, which also handles payment processing, invoicing, and the collection and remittance of VAT and other sales taxes.
Paddle’s Checkout Buyer Terms apply to every purchase, and Paddle provides customer service for payment-related inquiries.
Prices are shown at checkout including any applicable taxes, which Paddle calculates based on your location. We may change product prices at any time; changes do not affect orders already completed.
We never receive or store your full payment card details; payment data is handled by Paddle.
5. Refunds and the right of withdrawal
Refund requests for products are handled together with Paddle. Contact us or Paddle within 14 days of purchase; refunds for digital products are granted in line with Paddle’s refund policy and applicable consumer law.
EU/EEA consumers: you normally have a 14-day right of withdrawal. For digital content, by completing the purchase and receiving immediate delivery of the software and license key, you expressly consent to immediate performance and acknowledge that you lose the right of withdrawal once delivery has begun, to the extent permitted by law.
Subscriptions (such as Signetix plans or Care Plans) can be cancelled at any time and end at the close of the paid period; see Section 7.
6. Services and project work
Custom development, websites, migrations, security testing and similar services are provided on the basis of a written proposal or quote describing scope, timeline and price. Work starts after you accept the proposal.
Unless the proposal says otherwise: payment is split into milestones; upon full payment, the intellectual property rights in the custom code written specifically for you are transferred to you, excluding our pre-existing components, open-source components (which remain under their own licenses) and our general know-how.
Security testing (penetration tests) is performed only within a scope you have approved in writing and only on systems you own or are authorized to have tested. You are responsible for obtaining any third-party authorizations (e.g. from your hosting provider).
We warrant that services are performed with professional skill and care. We will remedy defects in delivered work reported within [30/60/90] days of delivery free of charge.
7. Care Plans and subscriptions
Care Plans are recurring services billed monthly or yearly. The current plan contents are described on the Site at the time of ordering.
Either party may cancel a Care Plan with 30 days’ notice; yearly plans run until the end of the paid year unless otherwise agreed. Statutory consumer rights remain unaffected.
First-month guarantee: if a Care Plan is not a fit within the first 30 days, we will refund that month on request.
8. Acceptable use
You may not use the Site or our products to break the law, infringe third-party rights, distribute malware, or attempt to gain unauthorized access to our or anyone else’s systems. We may suspend licenses or accounts used in violation of these Terms.
9. Third-party products and links
Some products presented on the Site (such as Job Organizer and File Lister) are distributed by our partner HDD Surgery and purchased or downloaded on their website under their terms. The Site links to third-party websites we do not control; we are not responsible for their content or practices.
10. Intellectual property of the Site
The Site’s content, branding and design are owned by us or our licensors. You may not copy or reuse them without permission, except as allowed by law.
11. Disclaimer and limitation of liability
The Site and the products are provided “as is”. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, our total liability arising out of or in connection with a product or service is limited to the amount you paid for that product or service in the 12 months preceding the claim, and we are not liable for indirect damages, lost profits or lost data (always keep backups).
Nothing in these Terms limits liability for intent, gross negligence, or any liability that cannot be limited under applicable law, including mandatory consumer rights.
12. Governing law and disputes
These Terms are governed by the law of the Republic of Serbia. Disputes fall under the jurisdiction of the competent court in [CITY], Serbia. If you are a consumer, you also keep the protection of the mandatory consumer-law provisions of your country of residence, and purchases through Paddle may additionally be governed by Paddle’s Buyer Terms. EU consumers may use the EU Online Dispute Resolution platform.
13. Changes to these Terms
We may update these Terms; the current version is always published on this page with its date. Material changes to subscription terms will be announced before they take effect.
